The team of lawyers of criminal practice of AO ALARIUS is involved in the protection of persons within the framework of criminal proceedings on the grounds of criminal offenses provided for in Part 2 of Art. 364, Part 1, 3 of Article 362, Part 5 of Art. 191 of the Criminal Code of Ukraine. As part of this proceeding, the prosecutor applied to the court with a request to apply a preventive measure in the form of round-the-clock house arrest to the suspect.
The team of lawyers of the criminal practice of our bar association provided full and effective protection of the interests of the client at the stage of consideration of the petition. During the court session, the defense thoroughly refuted the arguments of the prosecution regarding the existence of risks provided for by the CPC of Ukraine, and also focused on the lack of objective grounds for applying a stricter precautionary measure.
The court agreed with the lawyers' legal position and reached a conclusion on its validity and compliance with the principle of proportionality.
🔹 In satisfaction of the prosecutor's request for house arrest — denied.
🔹 The suspect is subject to the least stringent precaution — personal obligation.
This result is another confirmation that the timely formed legal position and professional work of criminal lawyers make it possible to effectively protect the rights of clients in various categories of cases. Lawyers of our association continue to provide reliable protection in criminal proceedings of any complexity.
