The team of lawyers of the criminal practice of AO ALARIUS won another procedural victory within the framework of the defense of the client in the criminal proceedings investigated by NABU detectives.
According to the results of the appeal review, the lawyers managed to prove the groundlessness of the restriction of the client's property rights. The Appeals Chamber of the Supreme Anti-Corruption Court (VACS) agreed with the arguments of the defense party, satisfied the appeals and completely overturned the decision of the investigating judge regarding the seizure of property.
At the same time, the court of appeal refused to satisfy the relevant application of the prosecution party. This decision allowed:
- fully restore the violated property rights of the owner;
- eliminate any restrictions on the disposal of assets;
- provide legal certainty for the client in the framework of complex criminal proceedings.
“Cases involving the seizure of assets under the jurisdiction of anti-corruption bodies require not only in-depth expertise in the CCP, but also the development of filigree defense tactics. The ability to convincingly defend the legal position before the WACC Appeals Chamber is a key factor for the restoration of justice”, - noted in the criminal practice of ALARIUS.
